General Terms and Conditions

of LEKA Hadergjonaj

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between LEKA Hadergjonaj (hereinafter referred to as the "Service Provider") and its customers (hereinafter referred to as the "Client").

2. Scope of Services

The Service Provider shall provide the agreed services in accordance with the individually negotiated contractual conditions with the Client. The services are provided to the best of its knowledge and belief using appropriate means and methods.

3. Conclusion of Contract

A contract is concluded when a written order or offer confirmation is received and both parties have agreed on the terms. The Client acknowledges the following terms and conditions. Amendments require the written consent of LEKA Hadergjonaj. LEKA Hadergjonaj reserves the right to change these general terms and conditions at any time without prior notice to existing contractual partners. Any changes affecting the contractual partners will be communicated to them in writing.

4. Prices and Payment Terms

4.1. Prices are based on the individually agreed offer.
4.2. Invoices must be paid within 14 or 30 days of receipt without deduction, unless otherwise agreed in writing.
4.3. In the event of late payment, the Service Provider reserves the right to charge reminder fees and default interest.

5. Obligations of the Contracting Party / Client

5.1. The contracting party agrees to provide all documents and information necessary for the performance of the agreed service in a timely manner, but no later than 48 hours before the service is provided. If the contracting party fails to comply and delays, disadvantages, or even non-performance of the service by LEKA Hadergjonaj occur as a result, the contracting party shall be liable for non-fulfillment of the contract. In this case, LEKA Hadergjonaj is entitled to claim compensation for the costs incurred thus far.
5.2. The Client must ensure access to the agreed service locations.
5.3. Any special requirements or safety precautions must be communicated to the Service Provider prior to commencement of the work.
5.4. Any defects or complaints must be reported immediately, but no later than 24 hours after the service has been provided.

6. Liability and Warranty

6.1. The Service Provider is only liable for damages caused by gross negligence or intent.
6.2. LEKA Hadergjonaj is liable for damages, disturbances, or interruptions caused by its employees.
6.3. The liability of LEKA Hadergjonaj is limited to the agreed service.
6.4. LEKA Hadergjonaj is not liable for damages, disturbances, traffic jams, delays, or interruptions of work caused by third parties or force majeure.
6.5. LEKA Hadergjonaj reserves the right to withdraw from a contract if work cannot be satisfactorily completed due to disruptive events caused by third parties or in the event of force majeure. LEKA Hadergjonaj adheres to data protection regulations.

7. Contract Duration and Termination

7.1. The contract is concluded for the individually agreed duration. If no specific duration or termination period is specified in the contract, the following termination periods shall apply:
• Private customers: 3 months to the end of the month (unless otherwise contractually agreed).
• Business customers (SMEs): 6 months to the end of the month (unless otherwise contractually agreed).
• For long-term contracts (e.g. annual or multi-year contracts), the termination period is also 6 months.
• Automatic renewal: Unless otherwise agreed in writing, the contract will automatically renew for the original duration if it is not terminated in time.

7.2. An order can generally be terminated up to 14 days before the agreed cleaning date by registered mail or email. In the event of termination after this period, a cancellation fee of 30% of the offered price will be charged. Orders that are to be executed in less than 14 days can only be terminated in exceptional cases if the service provision by LEKA Hadergjonaj is no longer possible.
7.3. Termination must be in writing. Termination does not release the contracting party or LEKA Hadergjonaj from the services or payments to be provided within the agreed contractual period.
7.4. The right to immediate termination for good cause remains unaffected.

8. Data Protection and Confidentiality

8.1. The Service Provider processes the Client's personal data in compliance with the applicable data protection regulations of Switzerland.
8.2. Both parties agree to maintain the confidentiality of all information obtained in the context of the contractual relationship.

9. Applicable Law and Jurisdiction

9.1. The contract is governed by Swiss law.
9.2. The exclusive jurisdiction for all disputes arising from or in connection with these GTC is the location of the Service Provider.

10. Severability Clause

Should any provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, the valid and enforceable regulation shall be deemed agreed whose effect comes as close as possible to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision. The same applies to any gaps in the regulation.
